Tax Administration to check anyone who paid more than EUR 5,000 for a holiday

People who have spent more than €5,000 on summer holidays will be subject to checks by the tax authorities, which say they are acting in accordance with the law and that travel agencies are just one link in the chain of control over individuals’ personal consumption.

The tax authorities have reportedly asked several travel agencies to provide them with data on all customers who spent more than €5,000 on various holiday bookings from 2018 to the end of 2020.

And while the largest association of travel agencies in Serbia, YUTA, cannot provide all the data because it is confidential, the tax administration says it is proceeding according to the Law on the Determination of the Origin of Goods and Special Tax, in force since March 12 this year, and is acting in full compliance with the provisions of the Personal Data Protection Law.

The director of YUTA has not yet received an official notification from the Tax Administration, but the information is coming in from individual agency owners. “We have also hired lawyers and hope that this situation will soon be clarified,” he says, adding that it is unclear why the Tax Administration determined €5,000 as the limit.

After the Association of Travel Agencies and Tourism Workers of Serbia, which stated that this request of the state institution was in contradiction with the Law on Personal Data Protection, reacted, the Tax Administration issued the following statement:

“The Law on Determination of Origin of Property and the Law on Tax Procedure and Tax Administration, which have been in force since 12 March this year, regulates the conditions, manner and procedure under which an individual’s assets and increase of those assets is determined, as is the special tax on the increase of assets for which an individual cannot prove that it was acquired in a lawful manner, as well as the bodies responsible for implementing these laws.”  

If in the previous procedure it seems likely that in a maximum of 3 years there will be a difference between the increase in assets and the declared income of more than 150,000 euros, the tax authorities will initiate the control procedure.
